JOHOR BARU: A 21-year-old man claimed trial at a Sessions Court on Thursday to the charge of seriously injuring a 16-year old girl.

Mohd Farezee Rozlan was charged with using criminal force to seriously injure the teenager on Oct 2 at around 9pm with three other suspects who are still at large.

He and the other three suspects also face a separate charge of gang robbery at the same time and place, allegedly robbing the 16-year-old victim of a mobile phone and RM25 in cash.

Both crimes were allegedly committed inside a Proton Waja car by the side of the road in front of the Western Union shop along Jalan Padi 1 in Bandar Baru Uda, Tampoi.

He was charged under Section 325 and Section 395 of the Penal Code for both offences.

Asst public prosecutor Zairani Tugiran offered bail at RM13,000 for both charges. Judge Aliman Musri set bail at RM8,000 and fixed Jan 16 for mention. The accused posted bail.

Meanwhile, in a Magistrates Court, Muhammad Faizul Mian, 19, from Taman Impian Emas in Skudai was ordered to pay RM1,500 fine and serve one day jail for stealing a grey jacket worth around RM59.90.

Muhammad Faizul, an employee at Sutera Mall in Johor Baru, pleaded guilty to committing the offence at the Carrefour hypermarket in Sutera Mall at around 8.30pm on Oct 5.

Magistrate Nor Shahid Abdul Malik ordered Muhammad Faizul to serve a two-month jail sentence if the fine was not paid.

The accused failed to pay the fine as he said he did not have relatives in Johor Baru.

TEEN SMOKERS:’I began to smoke because I was bored’

The two teenage boys sat in the corner scowling.

They had a reason for being unhappy. They were tricked by their mother who brought them to the Tanglin Quit-Smoking clinic.

Mum, Mariam Samad, took medical leave to bring her sons to the clinic. She was desperate.

She was at her wits end trying to get her sons, Amirul, 16 and Amir, 14 to quit smoking, a habit they had developed three years ago.

She tried nagging, scolding and giving them health scares. Nothing worked.

The mother moved them out of their boarding school after she learnt that they had picked up the habit there.

“They stank of cigarette smoke when they returned home for holidays.”

The 42-year-old woman transferred her sons to a day school, hoping she and her husband could pay more attention to their sons’ activities.

But that too was in vain. The boys were still at it.

Running out of options and hearing about the clinic, Mariam, brought her sons there last month.

“I am just so afraid they will soon start taking drugs,” said Mariam, adding that Amir needed to stop smoking immediately as he was asthmatic.

She had tried talking to them but without much success.

“You know teenagers. It is very hard to talk to them,” she said.

Before hearing about the Quit-Smoking clinic, Mariam tried to buy nicotine replacement drugs but found them to be expensive at RM150 for a three-week supply.

At the counselling session, the brothers were told that the cigarette is like a devil, which destroys the body and mind.

Amirul felt motivated to quit especially after reading the pledge to quit smoking for good. He could see the light at the end of the tunnel. “I am going to try to quit because I want to be healthy,” said Amirul after the session.

He said he did not like to see his lips turning black. He also had a girlfriend to think about.

Amirul, in recalling his smoking activities said he would smoke when he went out to town with his boarding school friends.

“I began to smoke because I was bored. School was not a challenge to me,” he said.

Now he said he would make an effort to quit smoking by not thinking about smoking.

Instead he would concentrate on his new hobby — dancing.

Over the past six months, Amirul joined his friends in taking part in the shuffle dance.

He felt sorry that his younger brother had also picked up the habit but said he did not teach him.

OPINION:

Teenager is a people the range age between 12 until 19 years old. Many teenagers began to smoke because they are bored. Normally, they are barest by influence guidance. They are more to believe their friends compared with their parents. The teenagers should to be control by our parents. Besides that, they are also need to given educate about religion since children’s. They are smoking when they are bore for to release tension. Little teenagers smoking because their habits.

Perhilitan swoop to save wildlife

KUALA LUMPUR: The Department of Wildlife and National Parks (Perhilitan) seized wildlife species and leather bags in three operations on Monday and Thursday.

The department’s law and enforcement division chief, Dr E. Sivanathan, said the first raid was on a wildlife park in Perak on Monday.

Seven members from the wildlife crime unit went to the park and seized an eagle-owl, five owls, a python and three cobras placed in several cages.

“The park has no license to breed or display the animals which are protected under the Wildlife Protection Act 1972,” he said yesterday.

Also on the same day, the Perhilitan enforcement unit at the Kuala Lumpur International Airport prevented an imported consignment from entering the country.

“We seized nine bags made from Yak leather from France. Yaks are an endangered species,” said Sivanathan.

Perhilitan personnel also confiscated a sack with 24 pythons from a man in an oil palm plantation near Tangkak in Johor on Thursday.

OPINION:

The Department of Wildlife and National Parks (PERHILITAN) seized many wildlife species in three operations. Any park has no license cannot to protected the animals. The park is illegal. The animals are protecting under the Wildlife Protection Act 1972. The members of the park are criminal. This situation will be to reduce the protected animals in Malaysia.

 

Toll rates study now in final stages, says Mohd Zin October 9, 2008

KUALA LUMPUR: The Works Ministry is in the final process of updating data on the overall study of the terms of the existing agreements with toll concession companies aimed at reducing the toll rates throughout the country.

“We are in the final stage of updating the data and we have made several options as well as a new traffic projection based on the capacity of the existing infrastructure.

“We also studied the implications if we were to reduce the toll – the financial burden borne by the concession companies today and in the future,” said its minister, Datuk Mohd Zin Mohamed, in the interview 60 Minutes With the Minister aired by RTM1 here on Wednesday night.

He said the ministry had set up a special committee on the Toll Rate Study, headed by the chairman of the Malaysian Highway Authority (MHA), and invited academicians, consultants and private firms to study and reevaluate the existing terms.

He said he would present the outcome of the study to the cabinet soon for a final decision. Mohd Zin said the study encompassed traffic data on each highway and how the toll collection was utilised by the concession companies concerned. – Bernama

Ringgit & Sense: Doing the right thing with fruits and vegetables October 9, 2008

Hanim Junoh, the New Straits Times Ringgit and Sense project has taught her the importance of serving nutritious food to ensure her family’s health.

Hanim, 37, said the family had been neglecting vegetables and fruits in their diet.

“Over the past three weeks, I have started to give my family more vegetables and fruits like rambutan, oranges and banana. My two sons, Mohd Afiq Azli, 13, and Mohd Awaluddin, 10, are finding it difficult, but they are slowly adapting to it.

“When I do not serve vegetables or fruits, they will now ask for them,” she said at her house in Kampung Mesira near Wakaf Baru yesterday.

Hanim said she was glad she took part in the project as she learnt a lot from other participants, especially in preparing healthy food for the family.

She said she would continue to buy cheap but quality groceries and stopped shopping for expensive but non-nutritional products.

“I will try my best to buy more fruits and vegetables and have identified Mydin’s dry items and the Gok Kapor and Kampung Cina wet markets in Kota Baru for meat, fish and other groceries.

“Eating right is as important as exercising and I will make sure my family does not miss it.”

Before she leaves for work, Hanim would prepare nasi lemak, sambal ikan bilis and boiled eggs for her family. She packs some of the rice to bring to her stall at Gok Kapor market.

Her barber husband Azli Che Loh, 44, has gone to Johor with a friend to look for work.

Over the past three days, despite limited time, Hanim managed to stock up her groceries. She bought 10kg of rice, eggs, chicken and ikan bilis at Kampung Cina market and a sundry shop near her house.

“I don’t mind spending more to ensure the food is fresh. It makes a whole lot of difference to the taste.”

SUMMARY

Hanim Junoh , who was little trader had been trained about the importance of serving nutritious food to ensure her family’s health. She has start to give her family more vegetables and fruits . for the first time, her son are finding difficult ,but they are slowly adapting to it. Lawyers: Court can order suspect to undergo testing October 9, 2008

KUALA LUMPUR: Police can apply for a court order to compel a suspect to undergo DNA tests or they can obtain a sample illegally which can be tendered as evidence, say lawyers.

These are among the suggestions by the legal fraternity in dealing with a suspect who refused to undergo the tests voluntarily.Kuala Lumpur Bar criminal practice chairman N. Sivananthan said police could seek refuge of a provision in the Criminal Procedure Code (CPC) in obtaining samples for DNA tests from stubborn suspects.

He said Section 5 of the CPC stated that laws as practised in England could be imported here provided it was not contradictory to the Penal Code.

“In the United Kingdom, the authorities are allowed to go to court to compel a person to undergo DNA examination.”

 

However, there were two criteria which must be fulfilled before the application was made to compel a suspect to undergo DNA tests.Sivananthan used the example of a sexual crime to explain the criteria.

“First, police must show the court that a foreign DNA was found in the victim’s private parts.

“Second, they must show that they have reasonable suspicion that the person whose DNA is being sought may be involved in the case.”

Sivananthan said that a High Court order in 2000 that a person could refuse DNA testing might not be applicable in criminal cases.

In that case, a woman wanted her ex-husband to take the DNA test to show that he fathered their child. She was applying for maintenance.

Bar Council criminal practice committee chairman Hisyam Teh Poh Teik said a person might refuse to undergo testing but it did not prevent the prosecution from tendering the DNA test results which were obtained illegally.

“Such evidence could be tendered as proof as long as it was relevant to the subject matter of the trial. This position has been affirmed following a number of court rulings,” he said.

Hisyam said the aggrieved party could only seek civil remedy for breach of privacy.

However, criminal lawyer Datuk V. Sithambaram said: “Even if a person volunteered for a test, his consent is needed before the results are made public.

“This is ensure that the doctor-patient privilege is not breached.”

Sithambaram was the counsel for engineer Hanif Basree Abdul Rahman, who was acquitted of the murder of sales executive Noritta Samsuddin.

All three lawyers agreed on one point: a person being investigated for a sexual crime should cooperate fully if he is innocent. The DNA test is the quickest and most reliable method to prove his innocence.

Failure to do so would result in an adverse inference being drawn against the person.

Lawyer Haresh Mahadevan, meanwhile, said DNA evidence alone was not conclusive to prove that a person was involved in a crime.

Merdeka mood dampened by too many other events October 9, 2008

 SUNGAI SIPUT: The Beijing Olympics and the Permatang Pauh by-election are two events “overshadowing” the festive mood leading up to the Merdeka celebrations, Deputy Information Minister Datuk Tan Lian Hoe said.

Brushing off suggestions that not many Malaysians were in the mood to celebrate, Tan said it was only because too many events were happening.

Saying that everybody was “so busy” watching the Olympics, Tan however expected the Merdeka mood to pick up and gain momentum starting next week.

“Another reason is the big slash of funds, by 50%, for the festivities as we do not want to celebrate lavishly.

“Nonetheless we hope every Malaysian can fly a flag which costs less than RM5,” she told reporters after a music festival at SM Shing Chung here on Saturday night.

She was responding to DAP stalwart Lim Kit Siang who had pointed out in Parliament that the festive spirit seemed to be lacking this year.

Tan said the Government had this year allocated some RM30mil for the National Day celebrations, half of what it had spent last year.

“But we are very glad every state and some organisations have started moving. Each state should try to celebrate Merdeka gloriously because it’s a meaningful day for our country. Malaysians should be proud to be Malaysians,” said Tan who urged schools, companies and more organisations to come out in full force.

The ministry, she said, had promoted the event through talk shows and commercials on radio and television.

Students gather to go hungry for 30 hours October 9, 2008

KLANG: Some 400 students from seven secondary schools here will go without food for 30 hours to experience what the world’s poorest children face every day and, at the same time, raise money for a humanitarian cause.

In high spirits, students, armed with sweaters and bottled water, filled the hall of HELP International College of Technology (HICT) here, yesterday as they began fasting at 10am.This year, participants of the 30-Hour Famine programme themed: “You’ve Got the Power” organised by HICT managed to raise RM55,000.

The money will be channeled to earthquake victims in China, cyclone victims in Myanmar and children living in poverty-stricken areas of Thailand, Laos and Malaysia.

SMJK Kwang Hua school camp leader Lee Pei Ying, 16, who was participating in the programme for the second time, said she wanted to drive home the message of not being wasteful to friends and family members.

 

“I feel they should know about the plight of children in poor countries and learn not to waste money on things we don’t really need and to be grateful for what we have as we are actually very lucky,” she said.Her schoolmate Lee Jia Leng, 16, said her parents felt it was very strange of her to contribute money and join the programme just to go hungry.

“However, they are very supportive as they know I am here for the experience.”

World Vision Malaysia chief executive officer Liew Tong Ngan said this was the first year the programme would be held on a “do-it-yourself” basis to empower young Malaysians and encourage greater participation from a wider cross-section of youths nationwide.

“Last year 5,000 people participated in the programme, but this year, because we have decentralised the event, 9,500 people are participating.

“This is the 11th year the annual World Vision 30-Hour Famine has taken place in the country and despite high inflation, we feel very encouraged as Malaysians still contribute despite having to adapt their lifestyle,” he said.

HELP University College president and co-founder Datuk Dr Paul Chan, who was present to launch the event, said the programme could serve to remind young Malaysians of how fortunate they are and not to take things for granted.

“We have so much so that sometimes we forget. We must never forget that it is our moral duty to help others,” he said.

The participants will be shuttled to the National Hockey Stadium in Bukit Jalil today where they will join 5,000 others for the Famine Countdown show and closing ceremony.

Bus operators want interim fare hike to stay on the road October 9, 2008

KUALA LUMPUR: Bus operators want an immediate 30 per cent fare hike as a temporary measure to start selling tickets for Hari Raya trips.

They said some operators have stopped selling express bus tickets for trips from September.
Konsortium Transnasional Bhd chairman Datuk Nadzmi Salleh said touts were now selling tickets.
“But the buses might not be there on the dates stated on the tickets,” he said here yesterday.
              Express and stage bus operators nationwide have asked for a 100 per cent hike after the recent fuel hike. The last fare increase was three years ago.

              Nadzmi said the interim increase would help bus companies cope with increasing operational costs while the government decides on a final increase.
“We understand the government needs time to decide on the right amount as they do not want to burden the poor but they should consider our plea for a temporary hike as bus operators are not making money.”
              Nadzmi, whose company runs a fleet of 1,500 buses, says he has been selling assets to reduce losses.
“Last year, the company sold RM27 million worth of assets to cope with the losses.
“The smaller bus companies are bleeding even more.”
              Nadzmi said nine bus companies had stopped operations since the fuel price hike.
“These companies have surrendered their licences to the Commercial Vehicle Licensing Board. There are others who have reduced the number of buses by half.”
              Nadzmi said some stage bus companies had stopped plying “social service” routes.
“This has also caused frustration among the rural folk,” he said.
             Companies which have surrendered their licences used to ply the Muar-Batu Pahat, Kajang-Bangi, KL-Kajang-Seremban and KL-Rawang-Tanjung Malim routes. Companies serving George Town and Ipoh have also ceased operations.
             Nadzmi said bus companies also hoped the government would provide them a larger diesel quota, suggesting 5,000 litres for stage buses and 9,000 litres for express buses a month.
At present, bus companies are given a quota based on the average usage over three previous months.
